1.    INTRODUCTION

These Terms and Conditions regulate the access and use of the present Website.

The Website is the property of PSA Sines - Terminais de Contentores, S.A. with registered office at Terminal de Contentores de Sines, Apartado 195, 7521-903 Sines, with the single registration and taxpayer number 504 605 534 (hereinafter "PSA").

By using or visiting the Website or any of the information, data files, written text, graphics, links, audio files or other sounds, photographs, videos or other images (collectively, "Content"), resources and services (collectively, including the Content, the "Services") made available through it, you, as a user of or visitor to the Website ("User"), accept (i) these terms and conditions of use ("Terms and Conditions") and confirm that you have read and understood the (ii) Privacy Policy posted on the Website, available for consultation at www.psasines.pt.

The Website is a consultation portal, with the purpose of publicising the services provided by PSA and attracting potential customers.

Through the Website, PSA gives the User access to its Services, which are subject to these Terms and Conditions, including updates, developments and/or new products.  

2.    USER RESPONSIBILITY

PSA reserves the right to change these Terms and Conditions at any time, simply by posting the changes online on the website, indicating the date they were updated, and it is the User's sole responsibility to check and comply with them at each use. Use of the Website after the publication of the changes constitutes acceptance of the updated wording of the Terms and Conditions. If you do not agree with the changes made or with the Terms and Conditions in general, you must immediately stop using the Website and the Services.

By accessing, using and downloading material from the Website, the User agrees, on its behalf and/or on behalf of the entity on whose behalf it is acting, to comply punctually with the the provisions of these Terms and Conditions, ensuring that it is empowered to act on behalf of the third party it represents, if so required.

It is expressly forbidden to access the Services by any means other than through the interface made available by PSA, as well as to access (or attempt to access) the Website and/or the Services through automated means (including the use of scripts or web crawlers).   Use of the website for purposes other than those for which the website is intended, including illegal purposes or any other purposes which may be considered harmful to the image of PSA, is expressly prohibited. Usurpation, counterfeiting, exploitation of usurped or counterfeit content, illegitimate identification and unfair competition incur criminal and/or administrative liability.   It is also prohibited for the User to create or introduce into this Website any type of virus or programmes that may damage or contaminate it, or to advise third parties to do so.  

3.    INTELLECTUAL PROPERTY

All the information contained on the Website and all the data and information compiled by PSA associated with it (such as data files, written text, Software, music, audio files or other sounds, photographs, videos or other images, hereinafter "intellectual property rights") to which you have access as part of the Services or through your use, are considered to be content owned by PSA or licensed to PSA for this purpose.

The User is not allowed to modify, rent, lend, sell, distribute or create a derivative work based on these contents (partially or totally), unless he has been expressly authorised to do so in writing, in advance, by PSA or by a third party who holds the respective intellectual property and personality rights.

The User acknowledges and agrees that PSA holds all intellectual property rights (whether these rights are registered or not and wherever in the world these rights may exist) relating to the content of the Website and Services. The ASF holds all rights not expressly granted to the User in these Terms and Conditions.

The User further agrees not to remove, obscure or alter any intellectual property rights notices (including copyright and trademark notices) that may be affixed to or inserted into the contents of the Website.

Unless you have been expressly authorised by PSA to do so in advance, nothing in these Terms and Conditions confers on you the right to use any of PSA's trade marks, logos, designs, domain names and other distinctive signs.

4. LIMITATION OF LIABILITY

PSA will use reasonable diligence to ensure that all information contained on the Website is accurate and up to date. However, the use and reading of the content of this Website is carried out exclusively at the User's risk and is provided on an "as is and as available" basis. By accessing the Website, the User acknowledges and accepts that the content may be incomplete, inaccurate, not up to date, or may not meet his or her needs and requirements.

The Users are solely and exclusively responsible for their use of the Website and its contents and for evaluating the information obtained through the Website.

PSA adopts appropriate security measures to detect the existence of viruses. Nevertheless, the User should be aware that the security measures for computer systems on the Internet are not entirely reliable and that the PSA cannot therefore guarantee the absence of viruses or other elements that could alter the User's computer systems (software and hardware) or the electronic documents and files contained therein.

PSA accepts no liability for damages resulting from the impossibility of accessing the services made available through the website, or for damages caused by viruses, interruptions of service, cancellation of content, issues related to the Internet, or related to the non-existence and/or malfunctioning of the User's electronic devices.

If you disagree with the Website, in part or in whole, or with these Terms and Conditions, you have the sole right to stop using the Website.

5. LINKS TO OTHER WEBSITES

To facilitate user accessibility, PSA may include links to websites on the internet that are owned or operated by third parties. When using links to such websites of third parties, you must review and accept the rules of that website before using it. You must also accept that PSA does not control the content of such a website and that PSA accepts no responsibility for material created or published by such third-party websites. In addition, any links to a non-PSA website are included for your information only and for your convenience and do not mean that you endorse the website or the products and services referred to therein.

6. PRIVACY POLICY

The Privacy Policy is available at www.psasines.pt. The document contains an explanation of the procedures adopted by PSA with regard to the processing of the personal data of its Users and the protection of their privacy when using the website.

8. MISCELLANEOUS PROVISIONS

These Terms and Conditions, and the User's relationship with PSA in accordance with them, are governed by applicable Portuguese law. The User and PSA agree to submit to the exclusive jurisdiction of the Judicial Courts of the District of Setúbal for the resolution of any dispute relating to the interpretation and/or execution of these Terms and Conditions, without prejudice to the applicable mandatory legal rules. Notwithstanding this, PSA may enforce injunctive relief (or an equivalent type of urgent legal relief) in any jurisdiction.
